Difference Between Dam And Fidya:
Fidyah is basically a way to compensate for something important you miss during Hajj or Umrah, like fasting or following a certain rule. It’s not a punishment, but more like a chance to fix things and show you’re still committed to the pilgrimage and following the sunnah of Prophet Muhammad ﷺ. Fidyah must be given in Makkah.
When Is Fidya Required?
- Doing things that are normally okay but not allowed during Umrah or Hajj: This includes wearing perfume, getting haircuts, or having intimate relations with your spouse.
- Missing an important step: This could be forgetting to enter the Ihram at the designated starting point (Miqat) before starting your pilgrimage.
- Harming living things or causing trouble at the holy site, such as killing an animal within its boundaries
Dam:
On the other hand, if you miss something you were supposed to do or break a rule during Hajj and Umrah, you can make it up by offering a small animal, like a sheep or goat, as a sacrifice. This sacrifice is called Damm and it has to be done in Makkah.
When Is Dam Required?
It is required to give Dam if any of the following things happen by mistake or you cannot perform it due to a valid reason;
- Missing any of the 6 wajib acts of Hajj
- Missing any of the 2 wajib acts of Umrah
- Doing any of the 6 things that break Ihram
- Entering the Miqat without coming into Ihram
- Applying perfumes to the body or clothing, or using scented substances
- Applying Henna or Kohl to the body
- That depilatory technique involves shaving, cutting, trimming, or otherwise removing hair from any part of the body
- Hunting a prohibited animal
- When it comes to male attire, it is proper to wear shoes that have an upper part of the foot and the feet’s ankles
- Omitting an obligatory action of Hajj or Umrah or not performing it in the way it should be performed
Fidyah & Dam Rules and Regulations
- Fidyah is not to be used intentionally to replace an obligatory rite of Hajj or Umrah
- It’s not obligatory to pay the penalty immediately, although it should be completed as soon as possible
- Make sure you complete the Fidyah before you pass away
- You don’t have to wait for specific days during Hajj (Tashreeq: between the 10th and 12th of Dhul Hijjah) to do the Fidyah
- The animal sacrifice for Fidyah needs to happen within the holy area of Mecca (the Haram)
- The animal you sacrifice should be old enough and in good condition, not sick or injured
- If you can’t afford the Fidyah yourself, someone else can pay for it with your permission
- The meat from the sacrificed animal goes to poor people, not the rich or yourself
